This agreement is issued by Picklers Park Roodepoort (Pty) Ltd, hereafter referred to as Picklers Park, and applies to all individuals on the premises of Picklers Park, including but not limited to members, trial participants, day visitors, group attendees, staff, instructors, and volunteers.
1. Assumption of Risk, Disclaimer & Waiver of Liability
In accordance with the Consumer Protection Act, 2008, and as a condition of entry onto these premises:
- By entering Picklers Park and participating in any activities (including but not limited to pickleball, playground, social events, or use of facilities), you voluntarily assume all risks of injury, illness, loss, or damage.
- This includes risks associated with sports participation, use of equipment, uneven surfaces, hot surfaces (kitchen/coffee equipment), or other accidents on the premises.
- You acknowledge and accept that Picklers Park, its directors, staff, volunteers, and affiliates shall not be liable for any injury, loss, damage, or theft sustained on the premises, except where caused by gross negligence or willful misconduct.
- Parents and guardians are fully responsible for the supervision and safety of minors in their care.
- Prominent disclaimer notice boards are displayed at the entrances and other key areas of the premises to ensure all guests are aware of these risks.
2. Health & Safety Declaration
You confirm that:
- You are in good physical condition and capable of participating in sports or recreational activity.
- You will inform staff of any medical conditions that may affect your safety.
- You will follow all posted signs, staff instructions, and safety protocols.
Emergency medical support is not guaranteed on-site. You are responsible for your own medical care in the event of an incident.
For your safety, Picklers Park recommends the use of protective eyewear when playing pickleball. Eye protection is especially encouraged for children and competitive players.
3. Code of Conduct
To ensure a safe, respectful environment, all visitors must:
- Show respect to others regardless of age, skill, gender, race, or background
- Refrain from profanity, aggressive behaviour, or unsportsmanlike conduct
- Use all equipment and facilities responsibly — including paddles, nets, fences, seating, and shared spaces. Report any damage or unsafe conditions to staff immediately. Do not misuse, move, or modify any fixtures or property without permission.
- Do not sit, lean, pull on, or jump over the pickleball nets, posts, or fences
- Supervise children at all times
- Wear appropriate footwear and clothing on courts
- Nudity, indecent exposure, or any conduct inappropriate for a family setting is strictly prohibited
- Do not bring pets
- No outside food or beverages are allowed unless explicitly approved by management
- No smoking or vaping anywhere on the premises
- No alcohol unless approved in writing for a private event
- No personal speakers or loud music unless part of a Picklers Park event
- Dispose of trash and clean up after yourself
Picklers Park reserves the right to ask anyone to leave the premises if they violate these expectations, without refund.
4. Court Rules & Restrictions
To maintain the quality and safety of our courts, the following are strictly prohibited on all pickleball courts including but not limited to:
- Chairs, tables, or furniture of any kind
- Bicycles, scooters, skateboards, or other wheeled items
- Hard-soled shoes, cleats, or any non-court-appropriate footwear
- Glass containers
- Chewing gum or sticky substances
- Pets or animals (except certified service animals)
- Food or drink (except water in closed bottles)
- Any item not commonly found on professional pickleball courts (e.g., PPA or USA Pickleball–sanctioned facilities), including personal décor, heavy objects, tripods, or any item that may pose a safety risk, obstruct play, or damage the court surface. Picklers Park maintains its courts to professional standards, and all items on court must meet basic health, safety, and facility protection guidelines.
- Do not attach, tape, tie, or hang any items (including signs, banners, decorations, or tape) to nets, posts, or fences. Adhesives, cable ties, or fasteners can damage surfaces and interfere with court play. Only authorised staff may install signage or temporary materials.
Players must wear non-marking court shoes at all times. Please help us protect the playing surface and ensure a positive experience for all.
If courts are busy, limit play to one game or 20 minutes, then rotate with waiting players.
5. Court Rotation & Fair Play Rules:
To ensure fair access and smooth rotation when courts are busy:
- If 4 paddles are waiting, all 4 players on court must rotate off after their game.
- If 2 paddles are waiting, winners stay on, losers rotate off.
- If all courts are occupied, singles games are not permitted (doubles only).
- No double-stacking: You may only queue (place your paddle) for one court at a time. Placing your paddle in multiple queues is not allowed.
Please respect paddle queues and rotate in a timely and courteous manner.
6. Group Responsibility
Group organisers (e.g., schools, churches, companies) are responsible for ensuring that all attendees in their group have been informed of and agree to this Visitor Agreement. By signing, the organiser accepts responsibility for the group's conduct and safety.
7. Photos & Social Media
We may take photos or short videos at any time while you are on the premises (including during casual play, events, or general activity) for use on social media or promotional material.
By entering Picklers Park, you acknowledge this and consent to the use of such media. If you do not wish to appear in any photography or video content, you must notify a staff member in writing upon arrival.
Please note that original, unwatermarked media are only provided when purchased as part of one of our paid photo packages.
8. Parental Consent for Minors
Minors under 18 must be accompanied by a parent or legal guardian unless prior written permission is provided to Picklers Park. The guardian assumes full responsibility and risk for any minor in their care.
9. Commercial Use & Instruction
No coaching, paid instruction, business activity, or resale of court time is allowed without prior written approval from Picklers Park.
Visitors are also prohibited from conducting any sales, promotions, marketing, or solicitation on the premises. This includes handing out flyers, displaying branded materials, or offering goods or services — whether informal or commercial — without written permission.
Casual photography and filming for personal, non-commercial use (e.g. social media posts, family videos) are permitted — provided they do not interfere with other guests or imply official endorsement by Picklers Park.
10. Security Monitoring
Picklers Park uses video surveillance (CCTV) for safety and security. By entering the premises, you acknowledge that you may be recorded. Footage is stored securely in accordance with the Protection of Personal Information Act (POPIA).
11. POPIA & Marketing Consent
In accordance with the Protection of Personal Information Act (POPIA), your contact details (email and number) will be collected and securely stored by Picklers Park for the purpose of communicating about your visit, sharing event updates, and sending future marketing related to Picklers Park offerings.
By signing this form, you consent to receiving such communications. You may opt out at any time by emailing hello@picklersparkroodepoort.co.za with the subject line “Opt-Out” and include your full name and the mobile number or email address you used when signing this form.
12. Entire Agreement & Revisions
This document constitutes the entire agreement between you and Picklers Park. These terms may be updated periodically. The latest version published at www.picklersparkroodepoort.co.za/visitor-agreement shall apply to all visits, regardless of the date of registration or signature.
By entering the premises and/or signing this agreement, you agree to be bound by the current version of the Picklers Park Visitor Agreement, available at www.picklersparkroodepoort.co.za/visitor-agreement. Picklers Park reserves the right to update these terms at any time without prior notice.
13. Jurisdiction
This agreement shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Any legal disputes shall fall under the exclusive jurisdiction of the courts of Johannesburg, South Africa.
14. Consent & Acknowledgment
By signing below, you confirm that you have read, understood, and agreed to the full terms of this Visitor Agreement, including the Code of Conduct, Waiver of Liability, POPIA consent, and Disclaimer Notice in terms of the Consumer Protection Act, 2008.
You acknowledge that:
- Your participation is voluntary and entirely at your own risk, except where injury, loss, or damage is caused by gross negligence or willful misconduct by Picklers Park.
- You are responsible for the supervision and conduct of any minors in your care.
- Prominent disclaimer notices are displayed at entrances and throughout the premises to ensure all visitors are aware of potential hazards.
- The latest version of this Visitor Agreement, as published at www.picklersparkroodepoort.co.za/visitor-agreement, applies to your visit, regardless of when you first registered or signed.
By signing, you agree to be bound by these terms and conditions.
